2. Description of Service
ObituaryMonitor is an automated obituary monitoring service that scans publicly available obituary sources and notifies users when potential matches are found based on the criteria they provide. We do not guarantee the accuracy, completeness, or timeliness of obituary information.
3. User Accounts
To use the Service, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Harass, stalk, or harm another person
- Collect information about others without their consent
- Engage in any fraudulent or deceptive practices
- Interfere with the operation of the Service
5. Payment and Billing
Paid subscriptions are billed in advance on a monthly or quarterly basis. You authorize us to charge your payment method for the subscription fees. Refunds are provided at our discretion. You may cancel your subscription at any time.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL OBITUARY NOTICES WILL BE CAPTURED. We are not responsible for delays, missed notifications, or inaccurate information from third-party sources.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBITUARYMONITOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by ObituaryMonitor and are protected by international copyright, trademark, and other intellectual property laws.
9. Termination
We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service will immediately cease.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
